Terms and Conditions

1. Acceptance of Terms

By accessing or using the Build Your Budget website, mobile application, or services (collectively, the "Services"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use our Services.

These Terms constitute a legally binding agreement between you and BYB (based in Malaysia).

2. Eligibility

By using our Services, you represent and warrant that:

• You have the legal capacity and authority to enter into these Terms.
• You are at least 18 years of age, or if you are under 18, you are using the Services with the consent and supervision of a parent or legal guardian.
• The information you provide is accurate, complete, and current.

4. Third-Party Account Syncing

Our Services allow you to sync with third-party financial institutions via aggregation providers (specifically Plaid for banking, SnapTrade for brokerages, and Ethplorer for crypto).

• Authorization: By connecting an account, you expressly authorize BYB and its service providers to access, retrieve, and store your account information (balances, transactions, holdings) on your behalf.
• Accuracy: We are not responsible for the accuracy or timeliness of data provided by third-party institutions. If a bank feed is delayed or incorrect, BYB is not liable for any resulting budgeting errors.
• Credentials: BYB does not store your banking passwords. These are handled securely by our aggregation partners.

5. Receipt Scanning (AI Features)

We use Artificial Intelligence (via Anthropic's Claude) to process images of receipts you upload.

• Accuracy: AI is not perfect. You acknowledge that OCR (Optical Character Recognition) may occasionally misread amounts or dates. You are responsible for verifying the accuracy of scanned data before saving it to your budget.
• Content: You agree not to upload images containing illegal content, sensitive personal information of others, or explicit material.

6. Pricing and Payment

Current Status: As of the "Early Access" phase, BYB features are provided free of charge.

Future Pricing: We reserve the right to introduce subscription fees for certain features (e.g., automated syncing) in the future. You will be notified in advance of any price changes, and you will have the opportunity to cancel your account if you do not agree to the new pricing.

7. Limitation of Liability

Please read this section carefully.

To the fullest extent permitted by law, BYB and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:

• Loss of profits, data, use, or goodwill.
• Financial losses resulting from budgeting errors or reliance on the Service.
• Service interruptions or data loss due to server failures (AWS) or third-party downtime (Plaid/SnapTrade).

Our total liability to you for any claims arising out of the use of the Service shall not exceed the amount you have paid to us in the past 12 months, or $100 USD, whichever is greater.

8. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. Any disputes arising from these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Malaysia.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page or sending you an email notification. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.
